Welche Zeiten sind einzuhalten? Die K\u00fcndigung muss dem Arbeitgeber nachweislich zugehen. <\/strong><\/span>Eine K\u00fcndigung per Mail oder Telefax entspricht nicht der Schriftform.\u00a0<\/p><p>Hierbei ist insbesondere die <strong><span style=\"color: #c3006b;\">Unterschrift (als eindeutige Willensbekundung)<\/span><\/strong> von Bedeutung, wie auch <span style=\"color: #c3006b;\"><strong>die Einhaltung der gegebenen Fristen (Datumsnachweis).<\/strong><\/span><\/p><p><span style=\"color: #c3006b;\"><strong>Wichtig: Eine einmal eingereichte K\u00fcndigung kann nicht einseitig durch den K\u00fcndigenden widerrufen werden!<\/strong><\/span><\/p><p>Empf\u00e4nger ist &#8222;die Dienststelle&#8220;, was ein weit gefasster Begriff ist. Es bietet sich jedoch von der Organisation an\u00a0<strong><span style=\"color: #c3006b;\">direkt den zust\u00e4ndigen Sachbearbeiter zu adressieren (vorher Zust\u00e4ndigkeit und Erreichbarkeit abkl\u00e4ren!)<\/span><\/strong>, um einen Verlust des Schriftwechsels zu vermeiden. Von der betriebsinternen Post m\u00f6chten wir (nur in diesem Fall) abraten.\u00a0<\/p><p>Erg\u00e4nzend hierzu empfehlen wir auch immer eine <span style=\"color: #c3006b;\"><strong>Kopie an den Personalrat<\/strong> <\/span>zu verschicken<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section eine abweichende Definition von Monat und Kalendermonat, jedoch z\u00e4hlt hier dann <strong><span style=\"color: #c3006b;\">der tats\u00e4chliche Kalendermonat <\/span><\/strong>als Bemessungszeitraum f\u00fcr die Fristen.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section B.\u00a0<span style=\"color: #c3006b;\"><strong>betriebsbedingte K\u00fcndigungen sein (Schlie\u00dfung von Abteilungen, etc.).<\/strong><\/span><\/p><p><span style=\"color: #c3006b;\"><strong>\u00a0<\/strong><\/span><\/p><p>Die oftmals erw\u00e4hnte &#8222;Unk\u00fcndbarkeit&#8220; von Arbeitnehmern im Tarifgebiet West des TV-L ist folgend definiert:<\/p><p>\u00a0<\/p><p style=\"padding-left: 40px;\">Nach [&#8230;]TV-L im Tarifgebiet West [&#8230;] k\u00f6nnen Arbeitsverh\u00e4ltnisse von Besch\u00e4ftigten,<strong><span style=\"color: #c3006b;\"> die das 40.
